Terms of Service

When you download or install the App, you need to read and agree to the terms of this Agreement. Please read and understand all the rights and restrictions set forth in this Agreement. If you do not agree to all of these provisions of this Agreement, you are not authorized to download, install or use our App and related services. Once you install, copy, download, access or use our App in any other way, you will be deemed to have accepted this Agreement and agree to be bound by the above terms. If you do not fully agree to the terms set forth in this Agreement, please do not install, copy or use our App.

1. Rights

Statement All of our intellectual property rights and related information may include, but are not limited to, written expressions and their combinations, icons, graphic designs, images, charts, color schemes, interface designs, layout frameworks, related data, additional applications, printed materials and electronic documents, all of which belong to us and are protected by copyright laws, international copyright treaties and other intellectual property protection laws and regulations.

2. Prohibited Uses

In addition to other prohibitions as set forth in the Terms of Service, you may not use the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any illegal acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, phish, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Services or any related website for violating any prohibited use.

3. Intellectual Property Ownership

Our company shall own all right, title and interest in and to the Technology and Services, including all associated intellectual property rights. This Agreement is not a sale and does not transfer to you any ownership or rights in or to the Technology or Services, or any intellectual property owned by our company. Our company or product names, logos, and product names associated with the Technology and Services are trademarks of our company or third parties, and no right or license to use them is granted. You agree that you will not remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices incorporated in or accompanying the Technology or Services.

4. License

By uploading, distributing, or otherwise using your User Content on any Application, you automatically grant, and you represent and warrant that you have the right to grant, to us an irrevocable, non-exclusive, royalty-free, and fully paid, worldwide license, with the right to grant sublicenses, to reproduce, distribute, publicly display, publicly perform, prepare derivative works of, incorporate into other works, and otherwise use your User Content solely for the purpose of displaying your User Content on any Application.

5. Disclaimer

The Application is provided on an "as is" and as available basis, and we (and its suppliers) expressly disclaim all warranties and conditions of any kind, whether express or implied, including warranties or conditions of merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, or non-infringement. We (and its suppliers) make no warranty that any Application: (A) will meet your requirements; (B) will be available on an uninterrupted, timely, secure, or error-free basis; or (C) will be accurate, reliable, complete, legal, or safe.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

6. Severability

If any provision of this Agreement is held invalid or unenforceable for any reason, the other provisions of this Agreement will be unimpaired and the invalid or unenforceable provision will be deemed modified so that it is valid and enforceable to the maximum extent permitted by law.

7. Eligibility

You represent and warrant that you are 13 years of age or older. If you are under 13, you may not use our products. You are solely responsible for ensuring that these Terms of Service comply with all laws, rules and regulations that apply to you. In addition, the Products are provided for your use only and not for the use or benefit of any third party.

8. Modifications

We reserve the right to modify or replace any of these Terms of Service, or to change, suspend or discontinue the Products (including, without limitation, the availability of any feature, database or content), at any time and at our sole discretion. We may post notice on the Site or send you notice through the Products by email or other appropriate electronic communication. We may also impose limits on certain features and services, or restrict your access to part or all of the Products, without notice or liability. Although we will provide prompt notice of modifications, it is also your responsibility to check these Terms of Service periodically for changes. Your continued use of the Products after you have received notice of any changes to these Terms of Service constitutes your acceptance of those changes, and those changes will apply to your continued use of the Products going forward. Your use of the Products is subject to the Terms of Service in effect at the time of your use.
